If You are an individual, You must be an adult of at least 18 years of age to obtain or use any Interactive Solutions Services, and by accepting these Terms, You confirm that (a) You are an adult of at least 18 years of age, and (b) You are accepting these Terms on behalf of Yourself and all others in Your household who will use the Interactive Solutions Services (You and such other users of the Interactive Solutions Services, collectively, “Users”). CONNECT 24 RESERVES THE RIGHT AT ITS SOLE DISCRETION TO CHANGE, MODIFY, ADD OR REMOVE ANY PORTION OF THIS SITE OR THESE TERMS, IN WHOLE OR IN PART, AT ANY TIME AND FOR ANY REASON. CHANGES TO THESE TERMS OR THIS SITE WILL BE EFFECTIVE WHEN POSTED. YOU AGREE TO REVIEW THESE TERMS PERIODICALLY TO BE AWARE OF ANY CHANGES. YOUR CONTINUED USE OF THIS SITE AFTER ANY CHANGES TO THE TERMS OR THIS SITE WILL BE CONSIDERED ACCEPTANCE OF THOSE CHANGES. THESE TERMS GOVERN YOUR USE OF THIS SITE. IN THE EVENT THAT YOUR CONTRACT (DEFINED BELOW) TERMINATES FOR ANY REASON OR ANY ALLEGED OR ACTUAL VIOLATION OF THESE TERMS OR GOVERNING LAW OCCURS, CONNECT 24 MAY, IN ITS SOLE DISCRETION AND WITHOUT NOTICE, BLOCK OR RESTRICT YOUR ACCESS TO THIS SITE AND/OR PURSUE LEGAL ACTION AGAINST YOU.
These Terms are in addition to any agreement (as amended, restated, modified or supplemented and including all exhibits, schedules, riders and other attachments to such agreement, the “Alarm Services Contract”) entered into by and between You and your alarm monitoring service provider or dealer (“Dealer”) under which Connect 24 provides Interactive Solutions Services as an independent contractor.
YOU AGREE THAT CONNECT 24 IS NOT AN ALARM MONITORING COMPANY OR INSURER AND IS NOT PROVIDING YOU WITH ALARM MONITORING SERVICES OR INSURANCE OF ANY TYPE. THE AMOUNTS YOU PAY FOR CONNECT 24 ARE NOT FEES FOR ALARM MONITORING SERVICES OR INSURANCE PREMIUMS AND ARE NOT RELATED TO THE VALUE OF YOUR PROPERTY, ANYONE ELSE’S PROPERTY LOCATED IN YOUR PREMISES OR ANY RISK OF LOSS AT YOUR PREMISES. INSTEAD, THE AMOUNTS YOU PAY ARE BASED SOLELY UPON THE VALUE OF THE SERVICES CONNECT 24 PROVIDES AND UPON THE LIMITED LIABILITY CONNECT 24 ASSUMES UNDER THESE TERMS. IF YOU WANT INSURANCE TO PROTECT AGAINST ANY RISK OF LOSS AT YOUR PREMISES, YOU AGREE TO PURCHASE IT. IN THE EVENT OF ANY LOSS, DAMAGE OR INJURY, YOU WILL LOOK EXCLUSIVELY TO YOUR INSURER AND NOT TO CONNECT 24 TO COMPENSATE YOU OR ANYONE ELSE. YOU RELEASE AND WAIVE FOR YOURSELF AND YOUR INSURER ALL SUBROGATION AND OTHER RIGHTS TO RECOVER AGAINST CONNECT ARISING AS A RESULT OF THE PAYMENT OF ANY CLAIM FOR LOSS, DAMAGE OR INJURY.
CONNECT 24’S SERVICES DO NOT CAUSE AND CANNOT ELIMINATE OCCURRENCES OF THE EVENTS THEY ARE INTENDED TO DETECT OR AVERT, INCLUDING, BUT NOT LIMITED TO, FIRES, FLOODS, BURGLARIES, ROBBERIES AND MEDICAL PROBLEMS. CONNECT 24 MAKES NO GUARANTY OR WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, THAT THE SERVICES PROVIDED WILL DETECT OR AVERT SUCH INCIDENTS OR THEIR CONSEQUENCES. CONNECT 24 DOES NOT UNDERTAKE ANY RISK THAT YOU OR YOUR PROPERTY, OR THE PERSON OR PROPERTY OF OTHERS, MAY BE SUBJECT TO INJURY OR LOSS IF SUCH AN EVENT OCCURS. THE ALLOCATION OF SUCH RISK REMAINS WITH YOU, NOT CONNECT 24. YOU RELEASE, WAIVE, DISCHARGE AND PROMISE NOT TO SUE OR BRING ANY CLAIM OF ANY TYPE AGAINST CONNECT 24 FOR LOSS, DAMAGE OR INJURY RELATING IN ANY WAY TO THE SERVICES PROVIDED BY CONNECT 24.
EXCLUSIVE REMEDY. IT IS IMPRACTICAL AND EXTREMELY DIFFICULT TO DETERMINE THE ACTUAL DAMAGES, IF ANY, THAT MAY RESULT FROM A FAILURE BY CONNECT 24 TO PERFORM ANY OF ITS OBLIGATIONS. UNDER NO CIRCUMSTANCES WILL YOU ATTEMPT TO HOLD CONNECT 24 LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY OR DAMAGES TO PROPERTY. IF, NOTWITHSTANDING THE PROVISIONS OF THIS PARAGRAPH, CONNECT 24 IS FOUND LIABLE FOR LOSS, DAMAGE OR INJURY UNDER ANY LEGAL THEORY RELATING IN ANY WAY TO THE SERVICES PROVIDED BY CONNECT 24, CONNECT 24’S LIABILITY TO YOU SHALL BE LIMITED TO A SUM EQUAL TO 10% OF YOUR ANNUAL SERVICE CHARGES FOR THE CONNECT 24 INTERACTIVE CONTROL SERVICES OR $500, WHICHEVER IS GREATER. THIS AGREED-UPON AMOUNT IS NOT A PENALTY. RATHER, IT IS YOUR SOLE REMEDY. UPON YOUR REQUEST, CONNECT 24 MAY AGREE TO ASSUME LIABILITY BEYOND WHAT IS PROVIDED FOR IN THIS PARAGRAPH BY ENTERING INTO AN AMENDMENT TO THESE TERMS SETTING FORTH THE EXTENT OF CONNECT 24’S LIABILITY AND THE ADDITIONAL CHARGES TO YOU.
THE ABOVE LIMITATIONS OF LIABILITY AND EXCLUSIVE REMEDY APPLY NO MATTER HOW THE LOSS, DAMAGE, INJURY OR OTHER CONSEQUENCE OCCURS, EVEN IF DUE TO THE PERFORMANCE OR NONPERFORMANCE BY CONNECT 24 OF ITS OBLIGATIONS UNDER THESE TERMS OR FROM NEGLIGENCE (ACTIVE OR OTHERWISE), STRICT LIABILITY, VIOLATION OF ANY APPLICABLE CONSUMER PROTECTION LAW OR ANY OTHER THEORY OF LIABILITY OR ALLEGED FAULT ON THE PART OF CONNECT 24, ITS AGENTS OR ITS EMPLOYEES.
IF ANY OTHER PERSON, INCLUDING YOUR SUBROGATING INSURER, MAKES ANY CLAIM OR FILES ANY LAWSUIT AGAINST CONNECT 24 IN ANY WAY RELATED TO THE SERVICES PROVIDED BY CONNECT 24 TO YOU, YOU AGREE TO INDEMNIFY, DEFEND AND HOLD CONNECT 24 HARMLESS FROM ANY AND ALL SUCH CLAIMS AND LAWSUITS, INCLUDING THE PAYMENT OF ALL DAMAGES, EXPENSES, COSTS AND ATTORNEYS’ FEES. YOUR DUTY TO DEFEND IS SEPARATE AND DISTINCT FROM YOUR DUTY TO INDEMNIFY AND HOLD HARMLESS AND ARISES UPON THE ASSERTION OF A CLAIM OR DEMAND AGAINST CONNECT 24 AND REGARDLESS WHETHER CONNECT 24 HAS BEEN FOUND LIABLE OR WHETHER CONNECT 24 HAS INCURRED ANY EXPENSE.
NO SUIT OR ACTION SHALL BE BROUGHT AGAINST CONNECT 24 MORE THAN ONE (1) YEAR AFTER THE DATE OF THE INCIDENT THAT RESULTED IN THE LOSS, INJURY OR DAMAGE, OR THE SHORTEST DURATION PERMITTED UNDER APPLICABLE LAW IF GREATER THAN ONE (1) YEAR.
THESE TERMS SHALL APPLY TO AND BENEFIT CONNECT 24 AND ITS AGENTS, EMPLOYEES, CONTRACTORS, SUBSIDIARIES, AFFILIATES, PARENTS (BOTH DIRECT AND INDIRECT), RESELLERS, SUPPLIERS AND OTHER PARTNERS.

Who Are We?
Tyco Safety Products Canada Ltd., operating as Connect 24, is a subsidiary of Tyco International Ltd., a public company listed on the New York Stock Exchange. Established in 1998, Connect 24 started as a service to activate and administer Skyroute cellular back up devices for security alarm dealers in the U.S. and Canada. In 2008, as service providers moved from an analogue service to a digital service, Connect 24 rapidly became the leading reseller of cellular primary and back up services for the security industry in North America. As the demand grew and with the evolution of technology, in 2011, Connect 24 launched its Connect 24 Interactive Control Services offering.
This Privacy Policy governs Tyco Safety Products Canada Ltd., operating as Connect 24, and its subsidiaries. Connect 24, "we", "us" and similar terms as used throughout this Privacy Policy refer to Tyco Safety Products Canada Ltd., operating as Connect 24, and its subsidiaries. When Required or Permitted by Law. From time to time, we may be compelled by legal action to release information. In certain circumstances, we may also be permitted by law to collect, use or disclose information without the consent of the individual concerned. For example, we may disclose personal information without consent if it is to be used in an emergency that threatens the life, health or security of the individual, or when collecting unpaid amounts owed or owing to us.
We protect your information.
We limit access to your personal information, through physical, electronic and procedural safeguards, to those persons who require it to provide our services and products. The location and manner of storage and access depends on the nature of the information, which may be stored or accessed electronically or in hard copy in Canada or in other countries.
